1. Acceptance of Terms
1.1. By accessing or using this site, you agree to these Terms and Conditions. If you do not agree, do not use the site or services.
1.2. You must be at least 16 years of age to use this site.
1.3. To access any paid service, you must be of legal age or otherwise have the legal capacity to enter into a binding contract.
2. Description of Services
2.1. ACCS provides cybersecurity services, including virtual CISO/CIO services, HIPAA security risk assessments, cybersecurity training, IT governance and documentation, and compliance and policy support.
2.2. ACCS provides ACCS Privacy Protection, a subscription service that identifies and removes client data from data broker sites.
2.3. ACCS provides Data Privacy Education content, including blog articles, zines, booklets, and speaking engagements.
2.4. ACCS reserves the right to add, remove, or modify any service at any time without notice.
3. Accounts
3.1. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.2. ACCS reserves the right to suspend or terminate any account that violates these Terms.
3.3. You agree to provide accurate, current information when creating an account and to keep that information updated.
4. Payments & Subscriptions
4.1. Subscriptions renew automatically until canceled and will be billed to the payment method on file.
4.2. ACCS reserves the right to change subscription pricing, with advance notice provided to affected users.
4.3. If a payment fails, ACCS may suspend the associated service until the issue is resolved.
5. Refunds
5.1. Digital services and products are non-refundable.
5.2. Physical products are refundable if returned in new, unused condition.
5.3. Bulk orders may be subject to a restocking fee.
5.4. Refunds are issued only in cases of a product defect or where the product received does not match its description.
5.5. Refunds and returns are further governed by the ACCS Refund and Returns Policy, which is incorporated into these Terms by reference. In the event of any conflict between that policy and these Terms, these Terms control.
6. Acceptable Use
You agree not to:
6.1. Engage in any unlawful, fraudulent, or harmful activity through the site or services.
6.2. Attempt to breach security or access other users’ or ACCS’s data without authorization.
6.3. Upload or transmit malicious code.
6.4. Misuse the ACCS Privacy Protection service, including submitting data you are not authorized to submit for removal.
6.5. Scrape, reverse-engineer, or resell ACCS content or services without permission.
7. Intellectual Property
7.1. All site content, branding, and materials, including zines and booklets, are owned by ACCS and protected by applicable copyright and trademark law.
7.2. You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial use only.
8. Disclaimers
8.1. Services are provided “as is” and “as available,” without warranties of any kind, express or implied.
8.2. ACCS does not guarantee uninterrupted or error-free service.
8.3. ACCS does not guarantee specific results, including with respect to ACCS Privacy Protection removals, which depend in part on the cooperation of third-party data brokers.
9. Limitation of Liability
9.1. To the fullest extent permitted by law, ACCS shall not be liable for any indirect, incidental, or consequential damages arising from use of the site or services.
9.2. ACCS’s total liability shall not exceed the amount paid by you to ACCS in the twelve (12) months preceding the claim.
9.3. Any dispute arising from these Terms shall be resolved through binding arbitration rather than in court, except where prohibited by law.
9.4. In any dispute, claim, or arbitration arising from or relating to these Terms, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs, in addition to any other relief to which it may be entitled.
10. Termination
10.1. ACCS reserves the right to terminate or suspend your access to the site or services at any time for violation of these Terms.
10.2. You may cancel or close your account at any time, subject to the billing terms in Section 4.
10.3. Provisions relating to intellectual property, limitation of liability, and arbitration survive termination of your account.
11. Governing Law
11.1. These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles.
11.2. Any arbitration arising under these Terms shall be venued in Sedgwick County, Kansas.
12. Changes to Terms
12.1. ACCS may update these Terms from time to time. Updates take effect upon posting, along with a revised effective date.
12.2. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
